1. Who we are

Evidence Based Nutrition LLC ("Evidence-Based Nutrition," "we," "us," or "our") is a Utah limited liability company that provides online nutrition education.

This policy explains what information we collect when you use our websites at evidencebasednutrition.com and e-bnutrition.com, sign up for our emails, attend our webinars, or enroll in our programs, and what we do with that information.

Our services are intended for people located in the United States.

2. We are not a healthcare provider

Evidence Based Nutrition LLC provides general nutrition education. We do not diagnose or treat any condition, we do not prescribe or advise on medication, and we do not replace your physician.

Because of this, we are not a covered entity or a business associate under HIPAA, and the information you share with us is not protected health information under that law. It is protected under this policy and under applicable state and federal privacy law.

If you share personal health information with us, such as lab results or a diagnosis, we treat it with care and we do not sell it. Please do not send us information you would not want stored in a business system.

3. Information we collect

3.1 Information you give us

• Name
• Email address
• Mobile phone number, if you choose to provide it
• Mailing address, if you provide it
• Payment information, processed by our payment provider and not stored by us
• Questions, comments, and messages you send us, including community posts and replies
• Health-related information you choose to share, such as biomarker results (LDL cholesterol, blood pressure, fasting glucose, A1c), weight, family health history, food logs, or details about your health goals

You are never required to share health information in order to use our education content.

3.2 Information collected automatically

• IP address
• Browser type and version
• Device type and operating system
• Pages viewed, links clicked, and time spent
• Referring website and exit pages
• Approximate location derived from IP address
• Cookie and similar identifiers

3.3 Information from others

If a physician refers you using a referral code, we learn that the referral came from that physician. If you find us through an advertising platform, that platform may tell us which ad you clicked.

4. How we use your information

We use the information we collect to:

• Deliver the programs, courses, webinars, and community features you sign up for
• Send you the emails and, if you consented, the text messages you asked for
• Answer your questions and provide support
• Process payments and manage your subscription
• Improve our content, our website, and our programs
• Measure how our advertising performs
• Meet our legal and tax obligations

We use health information you share only to provide education and support to you, and to improve our programs. If we ever want to use your individual results or story publicly, we ask you first and you can say no.

5. Text messaging (SMS)

If you provide your mobile number and check the consent box, Evidence Based Nutrition LLC may send you text messages. Depending on which consent you gave, these may include:

• Webinar reminders and join links
• Follow-up messages about our educational programs
• Check-in messages and program support for enrolled members

Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of registering for any event, enrolling in any program, or purchasing anything from us.

You may opt out at any time by replying STOP to any message. You may reply HELP for assistance, or contact us at info@e-bnutrition.com.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent, and this information will not be shared with any third parties.

We keep a record of your consent, including the date and time you gave it and the exact wording that was displayed to you.

6. Cookies and analytics

We use cookies and similar technologies to keep you signed in, remember your preferences, understand how the site is used, and measure our advertising.

The services we currently use for this include:

• Google Analytics and Google Ads, for website analytics and advertising measurement
• Microsoft Clarity, for anonymized session recordings and heatmaps that show how people move through our pages
• HubSpot, for email and customer relationship management
• LearnWorlds, which hosts our website, course platform, and community

7. Who we share information with

We do not sell your personal information, and we do not share it with third parties for their own marketing.

We share information with service providers who help us run the business, and only to the extent they need it to do that work. These currently include:

• Stripe, for payment processing
• HubSpot, for email and customer records
• LearnWorlds, for course delivery, community, and website hosting
• Zoom, for live webinars and video
• Twilio, for text messaging
• Google, for analytics and advertising
• Microsoft, for session analytics

Each of these providers is bound to use your information only for the services they provide to us.

We may also disclose information when required by law, court order, or valid legal process, or when necessary to protect our rights or someone's safety.

8. Business transfers

If Evidence Based Nutrition LLC is sold, merged, or reorganized, customer information may transfer as part of that transaction. We will notify you before this happens and give you the option to have your information deleted.

Mobile phone numbers and SMS consent records are excluded from any such transfer and will not be transferred to a new owner or controlling party. Anyone acquiring the business would need to obtain your consent again before texting you.

9. Your rights and choices

Email. Every marketing email has an unsubscribe link. You can also email us and we will remove you.

Text messages. Reply STOP to any message to opt out immediately and permanently.

Access, correction, and deletion. You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email info@e-bnutrition.com. We will respond within 45 days. There is no charge for this.

Account information. If you have an account, you can view and update most of your information by signing in.

California residents. Under the California Consumer Privacy Act as amended, you have the right to know what personal information we collect and how we use it, to request deletion, to request correction, to opt out of the sale or sharing of personal information, and not to be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined under California law. To exercise any of these rights, email info@e-bnutrition.com.

Other states. Residents of states with comprehensive privacy laws have similar rights. Contact us and we will honor them.

10. Data retention

We keep your information for as long as you have an account or an active relationship with us, and afterward only as long as we need it for legal, tax, or record-keeping purposes.

Session recordings and analytics data are retained on shorter schedules set by the services listed in Section 6.

You can ask us to delete your information at any time, subject to records we are legally required to keep.

11. Security

We use administrative, technical, and physical safeguards to protect your information, including encrypted connections, access controls, and password management. Payment card details are handled by Stripe and are never stored on our systems.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Children

Our services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, email info@e-bnutrition.com and we will delete it.

13. Changes to this policy

We may update this policy from time to time. When we do, we will change the "Last updated" date at the top. If the changes are significant, we will notify you by email or through the site.
